Terms of Use

Last updated: 12 October 2026

These Terms of Use govern the use of encopower.com, a website operated by ENCOPOWER İç ve Dış Limited Şirketi (“ENCOPOWER”).

1. Purpose and scope of the website

This website provides information about the low, medium and high voltage electrical equipment and industrial automation products supplied by ENCOPOWER and enables customers to submit enquiries and requests for quotations.

The listing of a product on the website does not, by itself, constitute a binding offer for sale or a commitment that the product is in stock.

2. Product information and technical specifications

Reasonable care is taken to keep product descriptions, technical specifications and images accurate and up to date. However, manufacturer updates, model variations or data entry errors may result in omissions or differences in the information displayed.

Product images may be illustrative. Before placing an order, the product code, technical specifications, accessories and scope of supply must be confirmed with ENCOPOWER in writing. Suitability for the intended use and project must be assessed against the relevant technical documentation and the requirements agreed between the parties.

These provisions do not remove ENCOPOWER’s contractual obligations or obligations arising under applicable law.

3. Requests for quotations and orders

Submitting a quotation request or contact form through the website does not, by itself, constitute an order or create a sales contract.

Product prices, quantities, payment terms, delivery times and other commercial conditions are determined by the relevant quotation and the parties’ written agreement. The validity period of a quotation is stated in the quotation document.

4. Prices, availability and delivery

Any prices, stock information and estimated delivery times displayed on the website are subject to confirmation before an order is placed. The relevant quotation specifies whether taxes, customs charges, transport, insurance and other costs are included in the price.

For international deliveries, the delivery terms and the responsibilities of each party are set out in the written agreement relating to the order. This provision does not grant a right to change the price or delivery terms of an existing contract unilaterally.

5. Warranty, returns and cancellation

Warranty coverage, returns and cancellation conditions are determined by the nature of the product, any applicable manufacturer’s warranty, the relevant quotation or sales contract, and applicable law.

Any special conditions for custom-made products or products sourced to order are communicated to the customer before the order is placed. Customer rights that cannot lawfully be restricted remain unaffected.

6. Intellectual property rights

ENCOPOWER’s original texts, designs, logos and other original content on the website are protected by applicable intellectual property laws. Except where permitted by law, such content may not be copied or republished for commercial purposes without written permission.

Third-party trademarks, logos, product images and technical documents belong to their respective rights holders. Unless expressly stated, the presence of a brand or product on the website does not mean that ENCOPOWER is an authorised distributor or official representative of that brand.

7. User responsibilities

Users must provide accurate information in contact and quotation request forms and use the website lawfully.

Activities that disrupt the website, attempts to gain unauthorised access, and the uploading of files containing malicious software are prohibited. Users must have the authority to share any documents they submit and must not infringe the rights of third parties.

8. Third-party links

The website may contain links to websites operated by manufacturers or other third parties. Their operators are responsible for the content and practices of those websites. Users should review the terms of use and privacy notices of linked websites separately.

9. Website availability and liability

ENCOPOWER takes reasonable measures to maintain the secure and orderly operation of the website. Temporary interruptions may nevertheless occur due to maintenance, updates or technical issues.

General information on the website does not replace project-specific engineering services or technical advice. These Terms of Use must not be interpreted as excluding ENCOPOWER’s liability for wilful misconduct or gross negligence, or any liability or obligation that cannot be limited under applicable law.

10. Personal data and cookies

Information about the processing of personal data is provided in the relevant privacy notices. Information about the use of cookies is provided in the Cookie Policy.

Visiting the website or reviewing these Terms of Use does not constitute explicit consent to all processing of personal data or to the use of non-essential cookies.

11. Changes

ENCOPOWER may update these Terms of Use to reflect changes in legislation, its services or the operation of the website. The current version is published on this page together with its last updated date.

Changes do not automatically amend sales contracts that have already been concluded.
